I understand that Sunny Side Up Art (the Business) wishes to use the Photograph(s) of the kids having an art session, featuring my child/children named below (the Child/Children), of whom I confirm I am the parent or guardian, for the purposes set out below.
For good and valuable consideration, (receipt of which I acknowledge), I confirm that:
1. I grant the Business exclusive permission to use the Photograph(s):
a. In presentations, specifically to show what sessions look like when applying for funding and grants.
b. In promotional materials, specifically on my website or to promote my business on social media.
c. In the advertising of goods or services, specifically wherever it is appropriate to show what a session looks like.
d. On the Business’ website, specifically on the gallery and pages of my website sunnysideupart.com.
e. In printer publications, specifically on my fliers or in the unlikely eventuality that I promote on a printer magazine.
(Specified Purposes)
2. I understand that my image may be edited, copied, modified, exhibited, publishes or distributed and waive the right to inspect or approve the finished product.
3. I waive the right to any royalties or other compensation arising or relating to the use of the Photograph(s).
4. I consent to the Business:
a. Storing copies of the Photograph(s) for the Specified Purposes or to it storing my contact details on its database in case it needs to contact me.
5. I have the right to:
a. Withdraw my consent to the Business using and storing copies of the Photograph(s) for the Specified Purposes at any time;
b. Withdraw my consent to the Business storing my contact details on its database;
c. Access the Photograph(s), and any information the Business holds about my children at any time; and
d. Request that the Photograph(s) and any information the Business holds about the Photograph(s), and any information the Business holds about my child/children be removed from any materials, future materials and internal databases by contacting the Business at this email address: info@sunnysideupart.com.
6. This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual dispute or claims) shall be governed by and construed in accordance with the law of Scotland. Each party irrevocably agrees that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
